What is ‘totting up’?

A driver may be banned from driving for a period if they have accumulated – or ‘totted up’ – 12  points on their driving licence in a 3-year period resulting in a court appearance, where an automatic ban of 6 months is usually imposed. This ban may be longer if the court feels that the circumstances warrant it.

Adroit’s specialist Road Traffic and Driving Offence legal advisers support those facing a ‘totting up’ ban with mitigation and defence, aiming to keep drivers on the road especially where a ban would result in exceptional hardship, would be damaging to family life, or would have a serious impact on career prospects.

What sort of penalties are imposed for a motoring offence?

Potential penalties vary depending on the offence, from attending a speed awareness course and paying a fine, to lengthy bans or even custodial sentences. For example:

  • An offer of a speed awareness course, payment of a fine or endorsement of points on a licence may be made for minor speeding offences
  • Driving while using a mobile phone attracts a fine and endorsement of 6 penalty points on a licence
  • Drink driving or drug driving may incur a minimum 12-month ban, an unlimited fine, and/or a custodial sentence
  • Dangerous driving can lead to a custodial sentence of up to 2 years, a lengthy ban and the need to take an extended driving test before a licence is returned
